General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed through our online shop www.jakobsimon.com . This offer is directed to natural and legal persons residing in Switzerland and the EU.

3. Offer and conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. By clicking the "Order with payment" button, you place a binding order for the products in your shopping cart. The contract is concluded upon our order confirmation via email.

4. Prices and payment terms

All prices are quoted in Swiss francs (CHF) or euros (EUR) and include VAT (where applicable). The prices listed on the website at the time of ordering apply.

Payments are made using the payment methods offered in the checkout, such as Shopify Payments, credit card, PayPal or Twint.

5. Delivery and shipping

Deliveries will be made to the address you provide. Information on delivery times can be found directly with the product. If a product is unavailable, we will notify you immediately.

The risk passes to the customer upon handover of the goods to the shipping company.

6. Right of withdrawal / right of return

Private customers residing in the EU have the right to withdraw from this contract within 14 days without giving any reason.

There is no statutory right of withdrawal for customers based in Switzerland. Returns are accepted as a gesture of goodwill and only after prior agreement. Personalized or used products are excluded from exchange.

Cancellation period

The cancellation period is 14 days from the day on which you received the goods.

Consequences of revocation

In the event of a cancellation, we will refund all payments we have received from you within 14 days at the latest. The refund will be made using the same payment method you used for the original transaction. You, as the customer, will bear the return shipping costs.

7. Retention of title

The goods remain our property until full payment has been made.

8. Warranty and Liability

The statutory warranty rights apply. Defects must be reported to us immediately. Any liability for slight negligence, indirect damage, or consequential damage is excluded – especially in cases of improper use or handling.

9. Data protection

Your personal data will be used exclusively in accordance with our privacy policy .

10. Applicable law and place of jurisdiction

Swiss law applies exclusively. The place of jurisdiction for all disputes is – to the extent permitted by law – 8260 Stein am Rhein, Switzerland.

11. Final provisions

Should individual provisions of these Terms and Conditions be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. Amendments and additions to these Terms and Conditions must be made in writing.
